Cancellation and Refund Policy

The Client understands and agrees that if, for any reason, they choose to remove or cancel themselves out of the Program, they shall give a 7-day notice. The Client also agrees that he/she will not receive any refund (partial or full) for any reason whatsoever for any payments made or credit card charges incurred. The Client warrants that he/she will not initiate any credit card chargebacks regarding purchases. Additionally, the Client agrees not to initiate the cancellation of any credit card(s) to avoid obligated payments regarding this purchase (partial or full) for any reason. Furthermore, the Client understands that he/she is solely and completely responsible for any indebtedness incurred as a result of entering into this agreement. Whether the Client chooses to assign full or partial rights (i.e. deciding to partner with another individual) hereunder or delegate his/her obligations under this Agreement, the Client understands that he/she is responsible for the complete and total balance due to Omnitra Marketing.

By providing your telephone number(s) and confirming your acceptance of SMS/text messages from Omnitra Marketing© through electronic and/or digital means, you expressly consent to receive recurring non-marketing and marketing text messages from Omnitra Marketing© and others texting on behalf of Omnitra Marketing. These messages may include text messages sent using an automatic telephone dialing system, sent to the telephone number(s) you provide. Your consent is not required to purchase any goods or services. Program Description

Omnitra Marketing and its service providers may use an automatic telephone dialing system to deliver text messages to you. These messages are intended to provide you with information about Omnitra goods and services, including exclusive, limited-time offers and promotions. 

Cost

Message and data rates may apply to each text message sent or received in connection with Omnitra Marketing text messages, as provided in your mobile telephone service rate plan, in addition to any applicable roaming charges. Please contact your mobile telephone carrier for details on pricing plans. Omnitra Marketing does not impose a separate fee for sending Omnitra Marketing text messages.

How to Opt-In

To opt in to receive text messages from Omnitra Marketing, please follow the instructions provided during enrollment.


How to Opt Out

To stop receiving text messages from Omnitra Marketing, use the mobile phone corresponding to the number enrolled in Omnitra Marketing text messages and reply “STOP” in response to a text message from the Omnitra Marketing text messaging program. You will then receive confirmation of your opt-out. This will only opt you out of the specific text messaging program associated with that phone number, and you will remain opted into any other text messaging programs where you have enrolled.

Your Mobile Telephone Number

You represent that you are the account holder for the mobile telephone number(s) that you provide. You are responsible for notifying Omnitra Marketing immediately if you change your mobile telephone number. You may notify Omnitra Marketing of a number change by emailing [email protected].


You agree to indemnify Omnitra Marketing in full for all claims, expenses, and damages related to, or caused in whole or in part by, your failure to notify Omnitra Marketing if you change your telephone number. This includes, but is not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act and applicable state telemarketing laws.

Access or Delivery to Mobile Network Is Not Guaranteed

Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of the control of Omnitra Marketing, and Omnitra Marketing is not responsible or liable for issues arising from them.

Eligibility

To receive Omnitra Marketing text messages, you must be 18 years of age or older. Omnitra Marketing reserves the right to require you to prove that you are at least 18 years of age.

Changes to Terms and Conditions

Omnitra Marketing may revise, modify, or amend these SMS Terms and Conditions at any time. We will provide notice of any such revision, modification, or amendment through reasonable means, including but not limited to email to any email address you provide or by text message to any telephone number you provide.  Said revision, modification, or amendment shall not apply retroactively and will not be effective until seven (7) days after we provide notice. If you do not agree to the revision, modification, or amendment, you must opt out of Omnitra Marketing text messages within the 7-day notice period.  If you do not opt out, you will be deemed to have accepted the revision, modification, or amendment.


Termination of Text Messaging

Omnitra Marketing may suspend or terminate your receipt of Omnitra Marketing text messages for any reason, including if Omnitra Marketing believes you are in breach of these SMS Terms and Conditions. Your receipt of Omnitra Marketing text messages is also subject to termination if your mobile telephone service terminates or lapses. Omnitra Marketing reserves the right to modify or discontinue, temporarily or permanently, all or any part of Omnitra Marketing text messages, with or without notice.


Communications and Consent to Electronic Notices

You may communicate with Omnitra Marketing via email, telephone, and our website. Omnitra Marketing may issue notices via various channels, including by sending email to an address you provide. You agree that such notices shall have legal effect.


You also agree that notices sent by email satisfy any requirement that notices be provided in writing. If you do not agree, do not use Omnitra Marketing products or services.
